These Terms and Conditions ("Terms") govern your use of services provided by Burton Auto Detailing LLC ("Burton Auto Detailing," "we," "us," or "our") at 3920 12th St NW, Canton, OH 44708, including services scheduled by phone at (330) 500-2257, by SMS, by visiting https://www.burtonautodetailing.com, or in person.
These Terms form a binding agreement between you and Burton Auto Detailing LLC. You accept these Terms when you (a) affirmatively check the "I agree to the Terms and Conditions" box on our online quote form, (b) verbally confirm acceptance to our staff or AI voice agent after being directed to this page, or (c) drop off or authorize work on your vehicle after receiving a written or verbal quote that references these Terms. If you do not agree to these Terms, do not use our services.
1. Services
Burton Auto Detailing provides automotive detailing services including, but not limited to, exterior wash and detail, interior detail, paint correction, ceramic coating, paint protection film (PPF), window tinting, vinyl wrap, glass polishing, brake caliper refinishing, paintless dent removal (through partner), and specialty services. Specific scope, pricing, and timeline for each engagement are confirmed at the time of booking.
Some calls to (330) 500-2257 are answered or placed by an AI voice agent; recording and consent disclosures are detailed in our Privacy Policy § 4.
2. Estimates and Pricing
Pricing ranges shown on our website and in marketing materials are estimates. Final pricing is determined after vehicle inspection and confirmation of scope. We will provide a written or verbal quote before beginning work. Significant scope changes during service will be communicated and re-quoted before continuing; unauthorized scope changes are not performed.
3. Appointments, Cancellations, and No-Shows
Appointments are required for all services. We confirm each appointment by SMS or email and disclose any applicable deposit, cancellation, or no-show fee at the time of booking.
- Cancellations 24 hours or more in advance: no fee.
- Cancellations less than 24 hours in advance: may be subject to a rescheduling fee of up to $50, disclosed at booking.
- No-shows: $50 fee, charged to the payment method you provided to secure the appointment.
By providing a payment method at the time of booking, you authorize Burton Auto Detailing to charge that payment method for any cancellation, no-show, or rescheduling fee disclosed at booking. You may dispute any charge by contacting us at booking@burtonautodetailing.com within thirty (30) days.
4. Payment
Payment is collected at the time of vehicle pickup unless otherwise agreed in advance. We accept cash, major credit and debit cards, and designated digital payment methods. We do not collect payment information by phone or SMS for security reasons.
Invoices not paid at pickup and not subject to a written extension accrue interest at the lesser of 1.5% per month (18% per annum) or the maximum lawful rate under Ohio Rev. Code § 1343.01. Returned-check or reversed-payment fee: $30 per occurrence, per Ohio Rev. Code § 1319.16. If we refer an unpaid balance to collections or to counsel, you agree to reimburse reasonable collection costs and attorneys' fees incurred, to the extent permitted by Ohio law.
5. SMS Program (Burton Auto Detailing SMS Notifications)
By opting in, you consent to receive recurring text messages from Burton Auto Detailing related to your service, including:
- Appointment confirmations and reminders
- Vehicle-ready alerts
- Customer-care replies to inquiries you initiate
- Post-service feedback requests (non-marketing)
Program scope. This program is a transactional and customer-care SMS program. Burton Auto Detailing does not send marketing or promotional SMS through this program. Any future marketing or promotional SMS program will require separate prior express written consent collected at that time.

- STOP:You may opt out at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, or any other clearly worded opt-out request (for example, "please stop texting me"). Opt-out will be honored regardless of capitalization, punctuation, or minor wording variation.
- Re-subscription: Reply START, YES, or UNSTOP at any time to resubscribe.
- Quiet hours:Automated SMS is not sent between 9:00 PM and 8:00 AM local time at the recipient's billing ZIP code. Messages you initiate to us, and our replies to messages you initiate, are not subject to quiet hours.
- No affiliate sharing:Phone numbers and SMS opt-in records are used solely by Burton Auto Detailing LLC for this program. We do not sell, rent, or share SMS opt-in data with any third party, affiliate, or marketing partner. Enrollment here does not enroll you in any other business's messaging program.
- Privacy: See our Privacy Policy. Mobile information and SMS opt-in data are not shared with third parties for marketing.
How Consent Is Captured
We collect SMS consent through three explicit opt-in channels, each recorded in our CRM with timestamp, phone number, consent channel, and the exact version of the consent disclosure shown at the time of opt-in, so every opt-in is fully auditable:
- Web quote form at burtonautodetailing.com/quote. A dedicated SMS consent checkbox must be affirmatively checked to opt in. The label reads: "I consent to receive SMS messages from Burton Auto Detailing LLC at the number provided - including appointment confirmations, reminders, vehicle-ready alerts, and customer-care replies. Message and data rates may apply. Message frequency varies. Reply STOP at any time to unsubscribe, HELP for support." Unchecked, no SMS is ever sent.
- Voice agent at (330) 500-2257.When a caller provides their phone number, our voice agent explicitly asks: "Is it all right if we send appointment confirmations and reminders to this number by text?" and records verbal consent before any outbound SMS is queued. If the caller declines, no SMS is sent.
- Direct inbound SMS to (330) 500-2257 with double opt-in. When a customer texts us first with an enrollment keyword (BOOK, SCHEDULE, or START), our first reply includes our brand, program details, STOP/HELP instructions, and asks the customer to confirm enrollment. No recurring program messages are sent until the customer replies YES to the confirmation. A general inquiry that does not use an enrollment keyword - or that is not confirmed with a YES after the enrollment reply - is treated as a one-time conversational exchange only: we will respond to the immediate question but will not enroll the number in recurring messaging unless and until the customer completes the double-opt-in sequence or opts in through the web form or voice agent.
You may request your own consent record at any time by emailing booking@burtonautodetailing.com. We will provide the record within a reasonable timeframe.

- Customer-care reply:"Thanks for your message! Someone from Burton Auto will follow up shortly. Need immediate help? Call (330) 500-2257. Reply STOP to unsubscribe."
- Post-service feedback (non-marketing):"Thanks for choosing Burton Auto Detailing! We'd love to hear how your service went. Reply with any feedback or questions, or call (330) 500-2257. Reply STOP to opt out."
- Opt-out confirmation:"You've been unsubscribed from Burton Auto Detailing SMS. Reply START to resubscribe."
6. Vehicle Drop-Off, Liability, and Indemnification
You represent that you are the legal owner of the vehicle, or are authorized to bring the vehicle in for service. You agree to disclose any pre-existing damage, mechanical issues, or sensitive personal items in the vehicle at drop-off. Burton Auto Detailing is not responsible for items left in the vehicle that were not disclosed at intake.
You agree to indemnify, defend, and hold harmless Burton Auto Detailing LLC, its owner, employees, and contractors from any claim, loss, cost, or liability (including reasonable attorneys' fees) arising from (a) items of value, firearms, controlled substances, biohazards, or other sensitive items left in the vehicle and not disclosed at intake, or (b) your misrepresentation of vehicle ownership or authorization. You have no obligation to indemnify Burton Auto Detailing for any loss caused by Burton Auto Detailing's own negligence, gross negligence, or willful misconduct.
While in our possession, your vehicle is covered under our garage-keepers insurance policy. To the maximum extent permitted by Ohio law, our aggregate liability for any claim arising out of or related to our services is capped at the greater of (a) the actual and reasonable cost to repair damage caused by our negligence, up to the applicable limits of our garage-keepers insurance policy in effect at the time of the loss, or (b) the amount you paid to Burton Auto Detailing for the specific service giving rise to the claim.
Excluded damages. In no event shall Burton Auto Detailing be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, loss of use, diminution in value, or rental-vehicle costs, even if advised of the possibility of such damages.
Carve-outs. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded under Ohio law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by our recklessness.
7. Service Limitations and Disclaimers
Detailing services improve a vehicle's appearance but cannot:
- Restore paint to factory-new condition in all cases (paint correction reduces but may not fully eliminate deeper scratches or oxidation).
- Eliminate odors that have permeated structural materials beyond standard cleaning's reach.
- Remove damage that pre-exists the service.
Detailing outcomes depend on the vehicle's pre-existing condition, age, paint chemistry, and environmental exposure. Burton Auto Detailing does not guarantee any specific cosmetic outcome, level of gloss, level of scratch removal, odor elimination, or useful life of any coating or film beyond what is stated in the manufacturer's express warranty delivered with the product. We document the vehicle's condition before and after service with photographs and notes. You are encouraged to inspect your vehicle at pickup before leaving the premises.
Mobile Detailing at Customer Locations
When we perform mobile services at an address you specify, you represent that (a) you own or are authorized to permit service at that location, (b) safe ground-level access, adequate lighting, and, where reasonably needed, access to a standard GFCI-protected 120V outlet and a water spigot are available, and (c) no Homeowners' Association or property rule prohibits the work. Burton Auto Detailing is not responsible for damage to pavement, landscaping, or structures arising from a location condition you did not disclose. A minimum-trip charge and travel fee apply and are disclosed at booking. If we cannot access the vehicle after arrival, a trip fee of up to $50 applies.
8. Photographs and Marketing Use
We photograph your vehicle before, during, and after service for documentation and quality-control purposes. These internal photographs are retained as part of the service record regardless of any marketing opt-out.
Separately, you grant Burton Auto Detailing a non-exclusive, royalty-free, worldwide license to use photographs of your vehicle (with license plate and any visible VIN obscured) for portfolio, social-media, website, and marketing purposes. This license continues until you revoke it.
Opting out or revoking this license. You may decline this marketing use at any time - either at booking, at drop-off, or at any later date - by emailing booking@burtonautodetailing.com. Within thirty (30) days of receipt of your revocation, we will remove your vehicle's photos from (a) burtonautodetailing.com, (b) our currently-active social-media profiles under our direct control, and (c) any future print or digital marketing placements. Photos already published in third-party print media or distributed to third-party content aggregators before revocation cannot practicably be recalled and are not required to be withdrawn.
9. Warranty Limitation
Burton Auto Detailing performs vehicle detailing services, including paint protection film, ceramic coating, and window tint. Burton Auto Detailing does not provide any express written warranty on its services or workmanship. Any manufacturer warranty on products installed - including paint protection film, ceramic coating, and window tint - is delivered with the service per the manufacturer's own terms and is the manufacturer's warranty, not Burton's. Each manufacturer warranty is between the customer and the manufacturer; warranty claims are directed to the manufacturer per the documentation provided with the product.
EXCEPT FOR ANY SUCH MANUFACTURER WARRANTY, ALL SERVICES PROVIDED BY BURTON AUTO DETAILING ARE PROVIDED "AS IS." BURTON AUTO DETAILING DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND THE IMPLIED WARRANTY OF NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY OHIO LAW.
Nothing in this Section shortens any limitations period provided by Ohio law or waives any right under the Ohio Consumer Sales Practices Act.
10. Governing Law, Venue, and Dispute Resolution
These Terms are governed by the laws of the State of Ohio without regard to conflict-of-law principles. You and Burton Auto Detailing each irrevocably consent to the exclusive personal and subject-matter jurisdiction of, and venue in, the state courts of Stark County, Ohio and the United States District Court for the Northern District of Ohio (Eastern Division), for any dispute arising out of these Terms or our services. Either party may bring qualifying claims in the small-claims division of the Stark County Municipal Court notwithstanding the foregoing.
Informal resolution first. Before filing suit, you agree to send a written notice of the dispute describing the claim and the relief requested to booking@burtonautodetailing.com and allow Burton Auto Detailing thirty (30) days to attempt to resolve the dispute in good faith. This thirty-day period shall toll any applicable statute of limitations.
11. Changes to These Terms
We may update these Terms from time to time. The Effective Date at the top of this page reflects the latest version. For material changes that expand our rights or limit yours, we will provide at least thirty (30) days' advance notice by email, SMS, or prominent website notice before the change takes effect. Continued use of our services after changes constitutes acceptance of the updated Terms.
12. Force Majeure
Burton Auto Detailing is not liable for delays or failures in performance due to events beyond our reasonable control, including severe weather, natural disasters, fire, flood, public-health emergencies, government orders, utility or internet outages, labor disruptions, supply-chain disruptions affecting specialty coatings or films, or carrier delays. In the event of a qualifying delay, we will contact you to reschedule as promptly as practicable.
13. Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy and any written service quote or product warranty we deliver to you, constitute the entire agreement between you and Burton Auto Detailing regarding our services, and supersede all prior oral or written communications.
Severability. If any provision of these Terms is held unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all of our assets.
Survival. Sections 6 (Liability), 8 (Photographs), 9 (Warranty Limitation), 10 (Governing Law), 12 (Force Majeure), and this Section 13 survive termination of the agreement.
